Elizabeth Holmes Is Pregnant with Her Second Baby, It Is Revealed, as She's Sentenced to 11 Years

 


Elizabeth Holmes is pregnant and will welcome her second child behind bars.

The Theranos founder, 38, is expecting her second baby, court documents revealed, per The New York Times.

Holmes was sentenced to more than 11 years in prison for multiple counts of fraud for claims made to investors and patients of her Silicon Valley blood-testing company.

Per court filings obtained by The Times, she became pregnant after being convicted in January.

Holmes, the subject of an HBO documentary as well as a Hulu miniseries starring Amanda Seyfried, welcomed her first child in August 2021, before her criminal trial began.

Birth records showed that Holmes and her partner Billy Evans welcomed a baby named William Holmes Evans on July 10 in Redwood City, California, according to ABC News.

That pregnancy was first disclosed to the court in March 2021 when her counsel and prosecutors filed court papers asking a judge to move her trial's start date given that she was due in July.

On Friday, Holmes received her sentence of more than a decade.

Judge Edward Davila ruled that Holmes would spend 135 months in federal prison. She will then serve 3 years of supervised release.

She was tried on 11 counts of fraud for claims made to investors and patients of her Silicon Valley blood-testing company, Theranos. The jury found Holmes guilty of four of the charges — three counts of wire fraud and one count of conspiracy to commit wire fraud.

Holmes was found not guilty of an additional four counts. The jury remained deadlocked on the other three charges, according to The New York Times.

Holmes first rose to prominence in 2014 as the founder and CEO of healthcare start-up Theranos, which duped investors out of millions by falsely purporting that its technology could run hundreds of medical tests using just a few drops of blood.

In 2015, Wall Street Journal journalist John Carreyrou reported that the machine Holmes was selling — dubbed The Edison — did not actually work and that the company was using outside technology and other subterfuge to fake positive test results. Federal authorities then investigated Holmes, indicting her in 2018.

During her trial, Holmes' defense attorneys sought to portray her as naïve, saying she didn't mean to defraud investors. Her attorney, Kevin Downey, told jurors that Holmes never cashed out any stock even as the company's fortunes tumbled.

Holmes testified in her own defense, saying her judgment was clouded during the time in question because of the alleged sexual, psychological, and emotional abuse she endured during her relationship with former Theranos executive Ramesh "Sunny" Balwani, her ex-boyfriend and co-defendant.

Balwani was convicted of 12 counts of fraud in July. Prosecutors have said he will be sentenced after Holmes is.

But prosecutors said Holmes knew exactly what she was doing.

Elizabeth Holmes, the founder of healthcare startup Theranos, was sentenced to over 11 years in prison after being found guilty of wire fraud and conspiracy.

Federal prosecutors asked Judge Edward Davila to sentence the disgraced CEO to 15 years in prison, less than the maximum sentence of 20 years. They also asked her to pay $804million in restitution.

They argued that Holmes displayed ‘arrogance,’ and never admitted guilt for her crimes. They also argued that she should pay the massive nine-figure restitution because ‘the company was never going to succeed.’

However, defense attorneys shot back at prosecutors over the sum, reminding them that Holmes was found not guilty of 4 of the fraud counts that she was charged with.

Judge Davila eventually ordered her to pay a smaller sum of $121million to 10 major Theranos investors, including Rupert Murdoch and Betsy DeVos.

Probation officers told the court that Holmes recommended she face even less jail time, asking for 9 years in prison.

Homes were hoping for a significantly lighter sentence. In hearings leading up to the sentencing, her lawyers argued that she should receive no more than 18 months served in home confinement.

Holmes is pregnant with her second child. Her first was born while she was on trial. In a 12-page letter sent to the court before the hearing, Holmes’s partner William Evans asked the judge for mercy for the young family.

During victim impact statements, Elizabeth Holmes stepped up to testify herself. Crying, she addressed the court and the other victims: ‘I stand before you taking responsibility for Theranos,’ Holmes said. ‘It was my life’s work.’

Holmes said she was ‘devastated’ by the failure of her company. ‘I regret my failings with every cell of my body,’ she said through tears.

Holmes founded her company Theranos in 2003 after dropping out of Stanford University.

Inspired by a childhood fear of needles, Holmes claimed to have invented the machine that could perform blood tests using only a finger prick.

Holmes was able to secure lucrative contracts with companies like Walgreens to distribute her blood testing machines, known as the Edison, for commercial use.

Theranos eventually attracted major investors and a high-profile board of directors, which included former Secretaries of State Henry Kissinger and George Schultz, former CDC Director William Foege, and former Secretary of Defense James Mattis.

Some of her early investors included News Corp chairman Rupert Murdoch and the Walton family, the owners of Walmart.

Theranos raised a total of $945million from investors, and at its peak in 2013 and 2014 was valued at over $ 9 billion.

The company imploded in 2015 and 2016 after researchers, whistleblowers, and reporting in the Wall Street Journal revealed that Edison could not function properly.

During the proceedings on Friday, Alex Schultz, the father of whistleblower Tyler Schultz and son of investor George Schultz, gave a victim impact statement to the court.

Alex testified that Holmes hired a private investigator to follow his son and that he ‘slept with a knife under his pillow’ out of fear for his life.

He also said he felt that his family was ‘desecrated’ after Holmes confronted his son with lawyers in their own family home.

Theranos’ stock value tanked as the news broke, and in 2018 Holmes was charged with eight counts of defrauding patients and investors.

At trial in January, Holmes was eventually found not guilty of the charges related to defrauding patients.

Sunny Balwani, the former Theranos president and Holmes’s romantic partner, was also found guilty of 12 counts of conspiracy, defrauding investors, and patent fraud.

He faces 20 years in prison, and his sentencing is scheduled for December 7.

Holmes’s quick rise to power and steep downfall was documented in the book ‘Bad Blood: Secrets and Lies in a Silicon Valley Startup’ by Wall Street Journal reporter John Carreyrou, an HBO documentary, and a Hulu series starring Amanda Seyfried.
